ABOUT THE JOB

The American Civil Liberties Union (ACLU) Foundation of Florida seeks a Compliance Coordinator and Operations Administrator to join our Executive/Finance Team and help protect the long-term integrity, governance, and regulatory standing of the organization. This position is based in Miami, Florida, with occasional coordination across Florida.

The American Civil Liberties Union Foundation of Florida (ACLU of Florida or ACLU-FL) is an affiliate of the national ACLU, a national public interest organization devoted to the defense of the Bill of Rights. The organization implements its vital civil liberties mission in all 50 states, in large part through affiliate entities such as the ACLU of Florida.

The ACLU of Florida, the state’s largest civil rights and civil liberties organization, employs litigation, public policy advocacy and organizing, and public education to protect and promote a broad range of constitutional values and individual rights, such as freedom of speech, racial justice, right to privacy, religious liberty, criminal justice reform, voting rights, reproductive rights, LGBTQ+ rights, disability rights, and immigrants’ rights. The ACLU of Florida litigates a broad range of complex constitutional cases in federal and state courts through direct representation, filing amicus briefs, and submitting administrative complaints to state and federal agencies.

Because of the confidential nature of this role, it is not a bargaining unit position.

WHAT YOU’LL DO

Working in close collaboration with the Finance Department, Development Department, Human Resources and the Board of Directors, the Compliance Coordinator & Operations Administrator will safeguard the organization’s internal compliance infrastructure across its C3 and C4 entities. This includes Collective Bargaining Agreement (CBA) compliance, contract management and review, board governance and Bylaws administration, employment policy and HR compliance, risk management and security oversight, and statutory compliance for both the Foundation and the Affiliate.

This is an internal compliance and governance function with a legal purview; it is distinct from, and does not sit within, the Legal Department, which retains responsibility for litigation, legal strategy, and external representation. This position instead serves as the organization’s internal steward of statutory, contractual, and fiduciary compliance.

YOUR DAY TO DAY

  • Governance, Contract & Labor Compliance:
    • Serve as the organization’s internal subject-matter expert on CBA compliance, monitoring adherence to CBA terms across departments and advising management on contractual obligations.
    • Partner with Human Resources on CBA implementation, grievance documentation, and labor compliance matters.
    • Own contract management and review for the organization, including intake, redlining, tracking of key terms, renewal deadlines, and risk flags across vendor, consultant, and contractor agreements.
    • Support, in collaboration with affiliate counsel, board governance functions, including maintenance and periodic review of the Bylaws, board policies, conflict-of-interest disclosures, board meeting compliance and statutory requirements.
    • Monitor and work with the Executive and Finance teams and counsel to ensure compliance with statutory requirements governing the relationship between the 501(c)(3) Foundation and 501(c)(4) Affiliate, including corporate filings, registered agent obligations, and documentation of shared services and cost allocation.
  • Development & Fundraising Compliance (C3/C4):
    • Serve as the organization's subject-matter expert on charitable solicitation laws, nonprofit fundraising regulations, and IRS requirements governing both entities.
    • Working with Development team, review acknowledgment procedures, receipting, gift processing timelines, pledge accounting, campaign reporting accuracy, and conduct periodic gift file audits.
    • Advise staff on the proper allocation of activities, expenses, and revenue between the Foundation and the Affiliate, and review donor-facing materials for appropriate C3/C4 language.
    • Help coordinate and facilitate periodic training for staff on lobbying restrictions and permissible-activity limits applicable to 501(c)(3) resources.
  • Human Resources and Employee Compliance:
    • Partner with Human Resources to ensure employee handbook, workplace policies, and onboarding/offboarding practices comply with applicable law and the CBA.
    • Support HR in monitoring compliance with employment law requirements, including recordkeeping, leave administration, and background check processes.
    • Advise on conflict-of-interest, confidentiality, and workplace policy matters in coordination with HR and management.
    • Assist HR with compliance-related components of employee training, including mandatory workplace trainings, and policy acknowledgments.
  • Risk Management, Security & Grants Oversight:
    • Partner with the Executive and Leadership teams on organizational risk assessments, incident response protocols, and physical and data security compliance.
    • Maintain the organization's insurance coverage calendar and escalate compliance risks to the Executive Director, Chief Financial Officer and Board as appropriate.
    • Monitor cybersecurity practices affecting donor and constituent data, partner with IT on CRM security, and oversee donor confidentiality policies.
    • Oversee compliance with foundation and government grant terms and coordinate with Development and Finance on reporting and audit readiness.
    • Serve as liaison to outside counsel, manage any needed RFPs and maintain retainer agreements for general counsel, labor and employment counsel, tax counsel, nonprofit counsel, defense and security counsel and other legal experts as needed.

WHAT YOU’LL BRING

While no one person will have all of the qualities enumerated below, the successful candidate will bring many of the following qualifications and attributes:

  • Legal background or experience preferred.
  • Minimum 5–7 years of relevant experience in nonprofit compliance, governance, or regulatory affairs, preferably including experience with unionized workforces and collective bargaining agreements.
  • Working knowledge of charitable solicitation laws, IRS rules governing 501(c)(3) and 501(c)(4) organizations, and permissible C3/C4 allocation practices.
  • Demonstrated ability to review, draft, and negotiate contracts, vendor agreements, and grant agreements.
  • Knowledge of nonprofit board governance practices, including Bylaws administration and board meeting requirements.
  • Familiarity with HR compliance functions, including employment law basics, leave administration, and workplace policy development, gained through partnership with HR or Employee Resources teams.
  • Familiarity with risk management and organizational security practices, including data security and insurance/risk oversight.
  • Ability to provide competent guidance to affiliate leadership on a wide range of compliance, contractual, and governance issues.
  • Skill in reading, analyzing, and interpreting complex legal, financial, and regulatory documents.
  • Ability to foster a cooperative, cross-departmental working environment.
  • Self-motivation and the ability to manage a complex, cross-functional workload with minimal supervision.

COMPENSATION

The ACLU of Florida is committed to equity, transparency, and clarity in pay. Compensation will be commensurate with experience, within the range of $90,200 to $110,500 (Pay Grade 12).

The ACLU of Florida provides excellent benefits, including health and dental insurance with generous vacation, holiday, and sick leave policies, as well as a Defined Contribution 401(k) Retirement Plan. Base vacation leave is five weeks per year, increasing to six weeks per year after five years of service.
